Bathtub to shower remodel - can I keep the spout? - bathtub height

I was able to remove the tub and replace it with a shower. But I want to keep the bill as it is useful to wash their feet or water from my tank. I would also say the amount of the valve to 32 inches, and maybe just replace the faucet with a new and similar. I live in Massachusetts. Do you know if it obscures the codes?
